The declaration of compliance is a legal requirement to submit information to the The Pensions Regulator, letting them know how you have complied with auto enrolment.  

There is a deadline by which TPR must have received this information and this date will vary from company to company and depends on what your staging date is.

It is done through a secure, online service which is accessed by the Government Gateway and the type of information you will be required to submit includes how many workers you have automatically enrolled and the pension scheme they have been enrolled into.

The declaration must be done even if you don’t have any employees eligible for automatic enrolment.

When will I need to submit by declaration?

Your deadline for declaration will be 5 months after your staging date.  It is mandatory to do this and you could get fined for not submitting your declaration on time.

When can I start completing this?

The Pensions Regulator recommends you start completing your declaration as soon as you can.    Filling in the details as you go through the staging process will help you to ensure you have the correct information and that you don’t miss your deadline.  

Don’t leave completing the form to the last minute – there is a lot of information to complete and you could run out of time.

What type of information do I need to provide?

You will need to know things such as the number of workers who were already members of a qualifying pension scheme on your staging date, the number or eligible jobholders automatically enrolled on your staging date, your Employer Pension Scheme Reference (EPRS) and the type of pension scheme you have used (personal or occupational).

Make sure you have everything in place in plenty of time so you have the key information you will need.

Can someone complete the declaration of compliance for me?

It is the responsibility of each company to complete a declaration of compliance, your pension scheme provider will not do this for you.  If you are using an accountant or payroll bureau they can submit this compliance for you by acting on your behalf.
